SMT JUSTICE T.RAJANI CRIMINAL PETITON No.1425 OF 2018 ORDER:

This petition is filed seeking for grant of anticipatory bail to the petitioner, who is sole accused, in Crime No.7 of 2018 on the file of Hiramandalam Police Station, Srikakulam District. The offences alleged are under Sections 506 and 509 IPC and Section 3(i)(r)(s), 3(ii)(va) of SC/ST (POA) Amended Act, 2015.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

A perusal of the complaint shows that the defacto complaint alleged that the petitioner has been humiliating her in her caste name continuously. Hence, Section 18 of the SC/ST POA Act does not permit this Court to grant anticipatory bail.

Accordingly, the Criminal Petition is dismissed.

However, the petitioner can file a petition seeking for regular bail by surrendering himself before the court below. The court below shall dispose of the bail application, if any filed, expeditiously, preferably on the same day, subject to the pressure of other work.
