HON'BLE SRI JUSTICE P. NAVEEN RAO CONTEMPT CASE NO. 1577 OF 2015 ORDER:

This Court by order dated 17.11.2014 in WPMP No. 43370 of 2014 passed the following order:

"Having regard to the submissions made, liberty is granted to the petitioner to submit a representation in writing to the 3rd respondent giving details of the property and requesting him to furnish market value and on verification of relevant records the 3rd respondent shall pass appropriate orders as warranted by law. If the 3rd respondent is agreeable with the stand of the petitioner that the total extent of land in Survey No. 129/2 is not covered by the land allotted to APSEB, he shall permit the petitioner to present the deed of conveyance and take further steps."

Alleging that the order of this Court has not been complied with, the present Contempt Case is filed. In the counter affidavit filed by Sri B.G.S.V. Prasad, Sub-Registrar, he deposed that as requested by the petitioner the 'Market Value Assistance Certificate' was issued to him and thereafter the petitioner has not submitted any document for registration.

The first limb of the order is complied with by furnishing 'Market Value Assistance Certificate'. As per the second limb of the order, consideration of document

for registration would arise only after a deed of conveyance is presented. The categorical assertion of the respondent is that the deed of conveyance is not presented.

Therefore, it cannot be said that the respondent has violated the orders of this Court. Accordingly, the Contempt Case is closed. It is open to the petitioner to work out his remedies as available under law.
