THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 21344 OF 2004 ORDER:

This writ petition is filed to declare the action of the respondents in not regularizing the services of the petitioners as agricultural officers in respondent No. 1-society as illegal and arbitrary and contrary to the judgment rendered by this Court in W.P.Nos. 1621 of 1993 and 26249 of 1995 and C.C.No. 133 of 1996 and sought a consequential direction to regularize the services of the petitioners.

When the matter is taken up for hearing, none appeared for the petitioners in spite of the fact that the writ petition is listed under the caption of dismissal. A perusal of the record disclosed that the petitioners have attained the age of superannuation and learned standing counsel appearing for the respondents contended that the petitioners are not entitled for regularization. It can be seen from the record that the petitioners were appointed as agricultural officers on daily wage basis under Social Forestry Scheme undertaken by respondent No. 1 in the year 1986 and they were allowed to continue in service till they attained the age of superannuation.

This Court having considered the above said aspects is of the considered view that unless and until the petitioners are regularized, they will not get service benefits. Therefore, this Court is of the considered view that this writ petition can be disposed of in the interest of justice directing the petitioners to submit a fresh representation seeking regularization of their services within two weeks from the date of receipt of a copy of this order and upon

such representation being received, the respondents shall consider the same so as to enable the petitioners to get some service benefits.

With these observations, the writ petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed in consequence. No costs.
