THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.1395 OF 2018 ORDER:

This petition is filed by the petitioners-A2 and A3 under Section 482 Cr.P.C. to quash the proceedings in Cr.No.696 of 2017 on the file of the Station House Officer, Meerpet Police Station, Rachakonda District, which was registered for the offences punishable under Sections 419, 420, 468 and 471 IPC. 2.

Heard learned counsel for the petitioners, learned Assistant Public Prosecutor representing the State and perused the record.

It is brought to the notice of this Court that the petitioners-A2 and A3 have purchased 350 square yards of land from A1 believing that A1 has title and possession over the property. Having come to know that the original title deed of A1 is fraudulent one, the petitioners have cancelled the sale deed executed in their favour by A1 by way of registration. 4.

Under these circumstances, the Station House Officer concerned shall not arrest the petitioners herein, but he should proceed with the investigation of the case and file charge sheet with regard to innocence or otherwise of the petitioners. The petitioners shall co-operate with the investigation. It is open to the petitioners to work out their remedies available under law after filing of charge sheet or final report as the case may be. 5.

With the above observation, the Criminal Petition is disposed of. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
