HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No. 9006 of 2016 ORDER:

This writ petition is filed seeking to declare the action of respondents in not granting 12 years Special Grade/Stagnation increment to the petitioners upon completion of 12 years of service in their respective posts, as arbitrary and illegal. Learned counsel appearing for the petitioners submits that the issue involved in this writ petition is squarely covered by a judgment of this Court in W.P.No.3800 of 2012, which was rendered based on the earlier judgment of this Court in W.P.No.3754 of 2010. In the aforesaid judgment, it was held that after completion of 12 years of service, the petitioners therein were entitled to 12 years Special Grade/Stagnation Increment irrespective of the fact in which region they have served.

Following the ratio laid down in the aforesaid judgment, the

Writ Petition is disposed of and the respondents are directed to grant 12 years Special Grade/Stagnation increment to the petitioners.

Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
