The petitioner filed this Writ Petition seeking to declare the order dated:10-12-2004 of the 2nd respondent in confirming the order dated:20-11-2003 of the 3rd respondent holding the petitioner guilty for pilferage and also raising demand. 2.
During the course of arguments, the learned Counsel for petitioner submits that the Division Bench of Honourable High Court in W.P. Nos.18093 of 2003 and batch, dated:20-10-2016 disposed of the Writ Petitions directing the respondents therein to transfer the cases pending before them to the Special Court constituted under Section 153(1) of the Indian Electricity Act, 2003 which came into force from 10-6-2003, for determination of the civil liability of the writ petitioners with regard to allegation of theft of electricity, and therefore, submits that the present Writ Petition may also be disposed of with the same direction by transferring the case to the Special Court, pending before the respondents.

In view of the above, this Writ Petition is disposed of accordingly directing the official respondents to transfer the file/case of the petitioner to the Special Court constituted under Section 153 (1) of the Indian Electricity Act, 2003 for determination of the civil liability of the writ petitioner, with regard to allegation of theft of electricity by petitioner. As a sequel, Miscellaneous Petition/s, if any, pending in this Writ Petition, stand disposed of.
