Heard.

Complaining that the respondents are digging canal in the existing pathway, the petitioners made an application before respondents 3 and 4 on 25-06-2015. Alleging inaction, the present writ petition is filed. Learned Government Pleader has received instructions from the 4th respondent, which state that basing on the request of the Assistant Engineer No.2, Special Section, Irrigation Department, Gokavaram, the Mandal Surveyor, Korukonda, has conducted survey with respect to surplus channel and the report is still awaited. He also states that there is no proposal for digging of canal. As such, the petitioner has filed the present writ petition merely on apprehension.

Taking note of the said stand of the 4th respondent that there is no proposal for digging of canal, the 4th respondent is directed to look into the representation of the petitioner, as referred to above, as and when there is any such proposal for digging of canal, and take appropriate decision in accordance with law.

Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
