THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2219 OF 2016 ORDER:

This petition is filed by the petitioner-A1 under Section 482 Cr.P.C. seeking to quash the proceedings against him in Crime No.1011 of 2015 on the file of Rajendranagar Police Station, Cyberabad, registered for the offence punishable under Sections 120B, 420, 468 and 471 r/w 34 IPC. Heard and perused the material available on record. It is alleged that the wife of the 2nd respondent was the owner of Plot No.120 admeasuring 300 sq. yards situated in Sridevi Cooperative Housing Building Society, Kaden village, Rajendranagar Mandal and after her demise, the 2nd respondent and his children succeeded to the said property. The 2nd respondent came to know that A4 created a forged sale deed dated 23.4.

2005 in respect of the above property as if it was obtained from the wife of the 2nd respondent and on the same day, A4 gifted the said property to his wife-A5, who in turn sold the said property to A3. On the complaint lodged by the 2nd respondent, a case was registered and A4 was arrested. Basing on his confession, the petitioner was added in the above crime. It is alleged that A1, who is a document writer, created fake documents. Learned Counsel for the petitioner submitted that except the confessional statement of A4, there is no other material on record to connect the petitioner with the above crime.

Considering the facts and circumstances of the case and the nature of the offence, this Court is not inclined to interfere with the investigation in the above crime.
