THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.2176 of 2025 ORDER:

This criminal petition is filed by the petitioners for grant of anticipatory bail in the event of their arrest in connection with FIR.No.1571 of 2024 of Vanasthalipuram Police Station. Petitioners are arrayed as accused Nos.12 and 15 in the said crime. The offences alleged against the petitioners are under Sections 406, 420, 120-B of Indian Penal Code and under Section 5 of the Telangana Protection of Depositors of Financial Establishments Act, 1999.

The case of the prosecution is that the defacto complainant lodged a complaint before police on 24.12.2024 stating that Anand Kumar, Ch. Ramchander are the Managing Directors and Praveen Kumar, Director, B.Venkatesh-DGM, G.Parijata-DGM, Ch.Pandu-DGM, S.Mahesh-DGM, Ch.Eshwar, Ch. Lingaswamy-DGM, K.Srinivas Goud and Manipal Reddy are the land owners who have established Janani Repo Projects Pvt. Ltd., besides GNR Arcade, Hills

Colony, Vanasthalipuram and appointed G.Shekhar as a Marketing Director to this branch and induced him to deposit Rs.1 lakh from his customers and they would pay another Rs.1 Lakh in 25 months in instalments of Rs.2 lakhs, plots will be registered under the guarantee of money deposited in the company. They promised to register a plot of 100 yards on deposit of Rs.10 lakhs. Believing the same, the complainant and others deposited huge amounts. Thereafter, they neither registered the plot nor returned the money. As such, requested the police to take necessary action against the petitioners. Basing on the said complaint, case was registered against the petitioners for the above offences. 3.

Heard Sri R.Mangulal, learned counsel for the petitioners and learned Additional Public Prosecutor appearing for the respondent-State.

The contention of learned counsel for the petitioners is that petitioners are no way connected with the said project and they are falsely implicated in this case. There are no specific allegations raised against these petitioners. They are not the Managing Directors of the said company. The only

omnibus allegations against these petitioners is that they are taking huge commissions, but even in the remand report there is no role attributed to these petitioners except that they are the Deputy General Managers of the company. As such, requested this Court to grant anticipatory bail to the petitioners.

On the other hand, learned Additional Public Prosecutor opposed bail on the ground that A.5 to A.15 on behalf of Vanasthalipuram Branch employed marketing staff from different areas and believing their words, the depositors deposited amount of Rs.3 Crores and cheated the public at large. As such, their custodial interrogation is necessary and requested the Court to dismiss this petition. 6.

Considering the submissions made by both the counsel and the material on record, the 2nd petitioner herein was shown as A.13 in Cr.No.768 of 2024, wherein the company name is Pudami Infra Projects and this project is also in the same premises and he was granted anticipatory bail in the said crime on the ground that there are no specific over tacts attributed to the petitioners therein. In the present case also

except omnibus allegations there are no specific allegations against these petitioners. As such, this Court deems it fit to grant anticipatory bail to the petitioners subject to the following conditions :

i.

The petitioners are directed to surrender before the Station House Officer, Vanasthalipuram Police Station within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioners on prearrest bail on executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to his satisfaction.

ii.

The petitioners shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks, for the purpose of investigation till filing of charge sheet, and thereafter, as and when required.

iii.

The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
