THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.1411 OF 2018 ORDER:
This petition is filed by the petitioner-accused under Section Cr.P.C.
to quash the proceedings in C.C.No.1307 of 2017 on the file of the Addl. Judl. Magistrate of I Class, Bhongir, which was taken cognizance of the offence punishable under Section 138 of the Negotiable Instruments Act.

Heard learned counsel for the petitioner, learned Assistant Public Prosecutor representing the State and perused the record.

Having argued for some time, learned counsel for the petitioner would submit that the petitioner is suffering from ill-health and therefore, her personal attendance before the Court below may be dispensed with.

There is a procedure under Cr.P.C. to dispense with the personal attendance of the petitioner during enquiry/trial. Whenever the petitioner is prevented from justifiable cause from attending the Court, she can file an application to dispense with her personal attendance. In such event, the Court below may consider the same in accordance with law. As far as merits of the case are concerned, there are no grounds to quash the proceedings. 5.
With the above observation, the Criminal Petition is disposed of. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
