THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO Crl.P.No.3073 of 2015 ORDER:

This Criminal Petition is filed to quash Crime No.578 of 2014 on the file of Police Station Miyapur, Cyberabad, Telangana State. 2.

Petitioners herein are A-3 and A-4 in the said crime. 3.

Learned counsel for the petitioners contends that the petitioners are accused in the above crime and they are alleged to have committed offences under Sections 3, 4, 5 and 6 of Prevention of Immoral Trafficking Act, 1956 (for short 'the Act'); that the petitioners are only customers in the flesh trade and as per the decisions of this Court in Goenka Sajan Kumar Vs. The State of A.P. and Z.Lourdiah Naidu Vs. State of Andhra Pradesh, and the order dt.19-03-2015 in Crl.A.No.1795 of 2015, the petitioners cannot be prosecuted under the Act. 4.

Learned Public Prosecutor does not dispute the legal proposition.

In this view of the matter, it is held that the petitioners being only customers in the flesh trade cannot be treated as offenders under the said Act. Therefore, proceedings against them are quashed.

The Criminal Petition is allowed and Crime No.578 of 2014 on the file of Police Station Miyapur, Cyberabad, is quashed. 7.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
