THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.3966 of 2018 ORDER:

In this Writ Petition, petitioner challenges the action of respondents 2 to 4 in not providing electricity connection with respect to his house bearing assessment No.579 in Survey No.58/A situated at Konanki Village, Marturu Mandal, Prakasam District, in spite of his submitting documents with regard to his ownership over the property and in view of the direction issued by this Court in Writ Petition No.31969 of 2017 vide order, dated 10.10.2017.

Heard learned counsel for the petitioner and learned Standing Counsel for APSPDCL appearing for the respondents As per Section 43 of the Electricity Act, 2003, it is for DISCOM to provide electricity on demand. In view of the same, as and when an application is submitted for providing electricity connection, the same may be considered subject to the condition of the applicant's fulfilling necessary conditions as mandated by the Andhra Pradesh State Electricity Regulatory Commission and the General Terms and Conditions of Supply.

CKR, J W.P.No.3966 of 2018 Having regard to the above and in view of the nature of relief sought by the petitioner, this Court disposes of the Writ Petition with the direction to the respondents to consider the application of the petitioner for providing electricity connection in respect of the subject property and pass necessary orders in the light of the statutory mandate, within a period of three (3) weeks from the date of receipt of a copy of this order. Miscellaneous Petitions, if any pending shall stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J 9th FEBRUARY, 2018.
