ORDER:

This Writ Petition is filed for a Mandamus to set aside proceedings No.B/3077/2008, dated 28.12.2008, of respondent No.4, whereby he has suspended the petitioner's fair price shop authorisation.

This Court by order, dated 21.01.2009, while admitting the Writ Petition, granted interim suspension of the impugned order with the observation that the said order will not preclude the respondents from holding enquiry and taking further action.

In the counter-affidavit filed by respondent No.4, it is inter alia stated that during the pendency of the Writ

Petition, he has held enquiry and completed the same and that in view of admission of this Writ Petition, he could not pass a final order.

This stand of respondent No.4 is contrary to the order passed by this Court, wherein, as mentioned above, he was directed to proceed with the enquiry and take further action. Respondent No.4 appeared to have completely misread the said order and failed to pass a final order despite completing the enquiry.

In these facts and circumstances of the case, respondent No.4 is directed to forthwith pass a final order, in any case, not later than one month from the date of receipt of a copy of this order and take further action depending upon the nature of the order he may pass.

Subject to the above direction, the Writ Petition is disposed of.
