HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.5111 of 2014 ORDER :

This criminal petition is filed by the petitioners/accused under Section 482 Cr.P.C to quash the proceedings in Crime No.281 of 2013 of Tadepalli Police Station, Guntur Urban District registered for the offences punishable under Section 420 I.P.C and Section 4 of the Dowry Prohibition Act.

2) It is represented by the learned Public Prosecutor that the prosecution agency filed the charge sheet after investigation and the petition since filed against the F.I.R no way survives and as such the petition becomes infructuous.

3) In the result, the petition is dismissed as infructuous. Needless to say the further remedy, if any, is left open to the petitioners and if the petitioners file any application under Rule 37 of Criminal Rules of Practice, the learned Magistrate shall consider and permit them to represent one of the accused for the other accused.

4) Miscellaneous petitions, if any pending, shall stand closed.
