HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE Writ Petition No.20183 of 2009 ORDER:

None appears for the petitioner. Learned Government Pleader appears for respondent Nos. 1 and 2.

Petitioner, in the present writ petition, makes the following prayer: "For the reasons stated in the accompanying affidavit, the petitioner herein prays that this Hon'ble Court may be pleased to issue writ, order or directions more in the nature of Writ of Mandamus declaring R. No. 22635/C8/2009, dated 31.07.2009, issued by the 2nd respondent in disqualifying the petitioner's valid driving license No. 3330/1984 for a period of six months as illegal and arbitrary and set aside the same and further direct the 2nd respondent herein to release the petitioner's driving license forthwith and pass such other order or orders in the interest of justice as otherwise the petitioner may be put to irreparable loss and hardship."

This Court, while admitting the writ petition on 22.9.2009, granted an interim order as prayed. By way of interim relief, the petitioner sought suspension of the order dated 31.7.2009 issued by the 2nd respondent, suspending his licence for a period of six months with a consequential direction to release his driving licence. Keeping in view the prayer made in the writ petition and the interim order passed by this Court, this writ petition, in my opinion, has rendered infructuous. That seems to be the reason why nobody is

coming forward to work it out on merits. Hence, the writ petition is dismissed as infructuous.

Consequently, pending miscellaneous applications shall also stand closed. No costs.
