The prayer of the petitioners in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue writ or direction more particularly one in the nature of writ of mandamus Mandamus declaring the action of the 4th respondent in not completing the enquiry vide Letter No B/707/2018 dated 02 01 2019 and 16 02 2019 in not mutating the petitioners names in online and not issued the pattadar passbooks and title deeds with regard to the land in Sy No 576 to an extent of Ac 0 30 gts each petitioners situated at Molangur Village Shankarapatnam Mandalam Karimangar District each petitioner by considering the Judgment and Decree dated 7 03 2019 in AS No 13/2013 passed by the Senior Civil Judge Huzurabad is illegal arbitrary and against the principles of natural justice and also violative of the Articles 14 19 21 and 300A of Constitution of India and consequently to direct the respondents to mutate the petitioners names in the revenue records and to grant / issue pattadar pass books and title deeds in respect of Ac 0 30 gts of each petitioner in Sy No 576 in the interest of justice and to pass and pass such other relief or reliefs as this Honble Court deems fit and proper in the circumstances of the case."
Perusal of the record reflects that the Tahsildar, Shankarapatnam Mandal, Karimnagar District, already issued a notice to the parties on 02.01.2019. The complaint of the petitioners presently is that he is not completing the enquiry proceedings.
In the light of the order proposed to be passed by this Court without going into the merits of the case, it would not be necessary to put the unofficial respondents on notice or afford them an opportunity of hearing. It is not open to the Tahsildar, Shankarapatnam Mandal, Karimnagar District, to keep the enquiry pending indefinitely when the valuable property rights of the parties are involved.
The Writ Petition is accordingly disposed of directing the Tahsildar, Shankarapatnam Mandal, Karimnagar District, to complete the enquiry and take appropriate action on the strength thereof in accordance with the due procedure expeditiously and in any event, not later than three months from the date of receipt of a copy of this order, be it from whatever source.
Pending Miscellaneous Petitions, if any, shall stand closed. No order as to costs.
