THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN CONTEMPT CASE NO.1855 OF 2013 ORDER:
By order in W.P. No.18255 of 2013 dated 27.06.2013, this Court permitted the petitioner to file an application in the prescribed form for grant of D-1 patta certificate under Section 4(1) of the A.P. Rights in Land and Pattadar Pass Books Act, 1971, and the Tahsildar concerned was directed to consider the same; and pass orders thereupon in accordance with law within two months thereafter. The petitioner's application was received, and after examination, a patta was issued in their favour for an extent of Ac.5.00 cts.
The grievance of Sri Y.N. Lohita, Learned Counsel for the petitioner, is that, while the petitioner had submitted an application for being granted patta for a particular piece of land, they were granted patta for a different piece of land. The order of this Court only required the Tahsildar to consider the petitioner's application, and pass orders thereupon. No direction was issued to the Tahsildar to grant a patta certificate, for the land which the petitioner had sought a patta for. The very fact that the petitioner has been granted a patta for another piece of land would itself shown that their application for grant of patta for the other piece of land was not favourably considered.
I see no reason, therefore, to proceed against the respondent under the Contempt of Courts Act. It is made clear that mere disposal of the contempt case does not preclude the petitioner from questioning the order of the Tahsildar on its merits. The Contempt Case is, accordingly, closed. The miscellaneous petitions pending, if any, shall also stand closed. No costs. ______________________________ RAMESH RANGANATHAN, J
