Heard Sri C.V.R. Rudra Prasad, learned counsel for the petitioner.

No representation for the respondent. Of course, counter is filed resisting the request.

The fact remains that the petitioner has not been staying at Kakinada and without male assistance it is difficult for her to travel from Kakinada to Hyderabad where O.P.No.951 of 2015 is filed before the Family Court, City Civil Court, Hyderabad, and, therefore she seeks transfer of the said case to the Family Court, Kakinada, East Godavari District, Andhra Pradesh State. When she is taking shelter at her parents' house at Kakinada, though, they do not have children out of their wedlock, still, it would be arduous task for her to travel from Kakinada to Hyderabad to attend Family Court, City Civil Court, Hyderabad, without male assistance. This ground is sufficient to accede to the relief.

Therefore, the present Transfer Civil Miscellaneous Petition is allowed. O.P. No.951 of 2015 pending on the file of Family Court, City Civil Court, Hyderabad, is withdrawn and transferred to the file of Principal Senior Civil Judge, Kakinada. The transferee Court shall issue notices to both parties on receipt of case bundle and dispose of O.P. No.951 of 2015 in accordance with law. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions if any pending in the present Transfer Civil Miscellaneous Petition shall stand closed. ________________________ A.SHANKAR NARAYANA Dt. 01.05.2018 gbs
