HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.220 of 2016 ORDER:
This petition is filed to withdraw O.P.No.2077 of 2016 from the file of Family Court, Ranga Reddy at L.B.Nagar, and transfer the same to Family Court, Vijayawada.
2. Wife filed this petition. According to her affidavit, her marriage with respondent was performed on 26.09.2012 at St, Peter's Luthern Church, Bavajipeta, Vijayawada, as per Christian rites and custom and that she joined respondent and lead marital life happily for some time. She stated that respondent was addicted to bad voices and started harassing her to bring additional dowry and as she apprehended danger from the respondent and his family members, she lodged a complaint before A.S.Nagar Police Station and now living at her parents house on their mercy.
She stated that she filed M.C.No.245 of 2014 before Family Court, Vijayawada, which was allowed on contest. She further stated that she filed D.V.C.No.158 of 2015 before Additional Chief Metropolitan Magistrate, Vijayawada. She stated that respondent filed O.P.No.2077 of 2016 as a counter blast before Family Court, Ranga Reddy and she has to travel more than 275 kms. to defend the said O.P. She further stated that it is difficult for her to travel by meeting
travelling expenditure as she has no source of income at present. She stated that respondent is already attending Vijayawada Courts to defend D.V.C. and 498-A IPC cases and she is also apprehending danger at Hyderabad. For these reasons, she prayed for transfer of O.P.No.2077 of 2016 from Family Court, Ranga Reddy at L.B.Nagar, to Family Court, Vijayawada.
3. Respondent did not file any counter disputing the affidavit averments of petitioner.
4. Heard both sides.
5. Considering the submissions of both sides and considering the convenience of wife, O.P.No.2077 of 2016 is withdrawn from Family Court, Ranga Reddy at L.B.Nagar, and transferred to Family Court, Vijayawada, for disposal in accordance with law.
Family Court, Vijayawada, shall dispense with the presence of husband i.e., respondent herein for each and every adjournment. However, he shall appear as and when his physical presence is felt necessary for any specific purpose.
6. Accordingly, transfer C.M.P. is ordered.
7. Miscellaneous petitions pending, if any, shall stand closed.
