THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION NO.8348 of 2016 ORDER :

In view of the orders passed by this Court in Crl.P.M.P.No.11882 and 11883 of 2014 wherein this Court while considering the request of the petitioner seeking extension of time for staying out of country pursuant to the orders dated 25.04.2014 and relaxation of the conditions imposed on A3, passed the following order:

"Having regard to the above, both the applications are allowed in part, by extending four months further time to A4 and permitting A3 for four months to travel by taking back the passport from the trial Magistrate Court subject to execution of bond for Rs.50,000/- (Rupees Fifty Thousand only) with undertaking to return and redeposit the passport after said four months else confiscate the amount of bond by its recovery to the State as penalty under Section 53 of IPC. Needless to say hereafter any requirement is there, the petitioners shall not move this Court but for under Section 6(2)(f) of Passports Act, 1967 read with GSR 570 E Ministry of External Affairs, Union of India notification dated 25.08.1993 for travel permission and also for return of passport which is in deposit before the Court to consider on merits."

In view of the above, the petitioners ought to have moved an application before the Court wherein the passport is deposited, instead of approaching this Court.

Accordingly, the present Criminal Petition is disposed of giving liberty to the petitioners to make an application in terms of the order passed earlier in the said applications before the concerned Court. _________________________ JUSTICE C. PRAVEEN KUMAR 18.07.2016 vhb
