HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.3970 of 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioners, seeking the following relief: "......to issue an appropriate writ or order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent in not regularizing the petitioners plot No.250-A in Sy.No.66/2 of Rayadurg Navkhalsa Village, Srilingampally Mandal, Ranga Reddy District, under Layout Regularization Scheme as illegal, arbitrary and violation of Articles 14, 21 and 300-A of the Constitution of India and consequently to direct the 2nd respondent to regularize the petitioners both the Plots to an extent of 434 sq. yards in Plot No.250-A in Sy.No.66/2 of Rayadurg Navkhalsa Village, Serilingampally Mandal, Ranga Reddy District, under Layout Regularization Scheme and pass such other order or orders as this Hon'ble court may deem fit and proper in the circumstances of the case." 2.

I have heard the submissions of the learned counsel for the petitioners and of Sri Sampath Prabhakar Reddy, learned Standing Counsel for GHMC appearing for respondent Nos.2 to 4. I have perused the material record.

The case of the petitioner is that the petitioners made application, dated 30.12.2015, in respect of subject plot for regularization in accordance with terms of G.O.Ms.No.151, dated 02.11.2015, and that despite such application, the respondent Nos.2 to 4 are not taking any action.

Sri Sampath Prabhakar Reddy, learned Standing Counsel for respondent Nos.2 to 4 states that the petitioners' application would be considered appropriately within a reasonable time and the decision taken would be communicated to the petitioners. 5.

Recording the said submission, the Writ Petition is disposed of directing the 4th respondent to consider the petitioners' application referred to above within a period of eight (8) weeks from the date of receipt of a copy of this order and communicate the decision taken thereon to the petitioners within a week thereafter. Miscellaneous petitions pending, if any, shall stand closed. No costs.
