This Criminal Petition, under Section 4BZ of the Code of Criminal Procedure, 7973, is filed by the petitioners seeking to quash the order, dated 71.07.2073, passed in Proc.No.A/B80/2013, by the Executive Magistrate and Tahsildar, Bhainsa, wherein enquiry under Section 145 Cr'P'C' was scheduled to be held on 18.07.2013.

Learned Additional Public Prosecutor produced written instructions, dated 25.02.2021, before this Court, wherein it is stated as under:

"lt is further submits that the petitioner already evicted from the grave yard land and constructed boundary wall and there is no U/s 145 Cr'P C' proceeding pending on the graveyard land "

4. In that view of the matter, nothing survives for adjudication in this Criminal Petition.

Accordingly, the Criminal Petition is dismissed as infructuous.
