HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 10396 of 2017 Order:
Heard learned counsel for the petitioner and learned Government Pleader for the respondents 1 to 4.
The petitioner states that she is the absolute owner and possessor of agricultural land of an extent of Ac.6-00 gts., situated in Survey No.241/A of Kakarla village, Julurupad Mandal, Khammam district, having acquired the same under a registered document dated 25.12.1969. However, at the instance of one late Kalluri Uma Maheswara Rao, the third respondent took up enquiry in LTR Case No.1129/1994/JLP under the provisions of the Andhra Pradesh Scheduled Areas Land Transfer Regulations Act, 1969, and directed eviction of the petitioner from the said land. Against the said order, the petitioner filed WP No.14714 of 2002 and the said Writ Petition was disposed of, by an order dated 14.06.2007, giving liberty to the petitioner to file an appeal before the appellate authority.
Pursuant to the said order, the petitioner preferred an appeal before the second respondent in CMA No.270 of 2007 and the same was dismissed on 28.01.2017. Aggrieved by the same, she filed a revision petition before the first respondent on 15.02.2017 along with an application for stay. When the same is not disposed of till today, the present Writ Petition is filed.
This Court is not inclined to entertain the present Writ Petition challenging the order passed by the second respondent dated 28.01.2017, but in view of the claim of the petitioner as to possession of the property and non-disposal of the application for stay in the pending revision petition, this Court is inclined to dispose of the Writ Petition with a
direction to the first respondent to dispose of the revision petition filed by the petitioner herein, as expeditiously as possible, but not later than six
(6) months from the date of receipt of a copy of this order. In the meanwhile, the petitioner shall not be evicted from the possession of the above land. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
