THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO CIVIL REVISION PETITION NO. 1038 of 2015 ORDER:

The petitioner is the plaintiff in the suit. He has also moved Interlocutory Application I.A.No. of 2014 in O.S.No. 1 of 2014 seeking ad-interim injunction. The suit is entertained by the learned Subdivisional Magistrate Mobile Court, Rampachodavaram. However, no interim order has been granted on the interlocutory application so far and in the meantime, the opposite parties have also filed their counter to the interlocutory application. Hence, the interlocutory application is ripe for hearing and also for passing appropriate orders thereon. It is stated that the interlocutory application is not taken up for consideration by the learned Sub-divisional Magistrate Mobile Court, Rampachodavaram.

Instead of keeping this revision pending, ends of justice would be served adequately if I direct the learned Subdivisional Magistrate Mobile Court, Rampachodavaram to deal with the interlocutory application moved by the plaintiff in O.S.No. 1 of 2014, as expeditiously as possible, preferably within a maximum period of thirty days from the date of receipt of this order. In this view of the matter, there is no necessity to put the opposite parties on notice and hence, the civil revision petition is disposed of. Copy of this order to be dispatched to the learned Subdivisional Magistrate Mobile Court, Rampachodavaram. Consequently, miscellaneous applications pending shall stand closed. No costs.
