HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.5455 of 2019 ORDER:

The prayer of the petitioner in this case reads as under:- "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the 4th respondent in seeking huge amount in lakhs to enter the name connected to the Revenue records including pahanies of the petitioner land in Sy.No.628 extent Acs.7.05 Gts situated at Phanigiri Village of Nagaram Mandal, of Suryapet District, even though the petitioner is holding digital passbook No.

T29160030067 as illegal, arbitrary, violation of Principles of natural justice and violation of Articles 14, 16, 21 and 300A of Constitution of India and consequently direct the 4th respondent to record the name of the petitioner in connected to the Revenue records including pahanies in accordance with the digital passbook No. T29160030067 pertaining to the petitioner agricultural land in Sy.No.628 to an extent of Acs.7.05 Gts situated at Phanigiri Village of Nagaram Mandal of Suryapet District and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."

Sri P.Lalitha Kamesh, learned counsel for the petitioner, produced before this Court a copy of the new pattadar pass book issued to the petitioner in terms of the Government's policy for availing the benefit of Rythu Bandhu welfare scheme. Perusal thereof demonstrates that the land admeasuring Acs.7.05 guntas in Survey No.628 of Phanigiri Village, Nagaram Mandal, Suryapet District, was left out therein. The petitioner seems to have made a representation in this regard to the Tahsildar, Nagaram Mandal, Suryapet District, which was received by the office of the Tahsildar on 13.11.2018. Having received such a representation, it is not open to the Tahsildar concerned to remain somnolent.

SK, J WP.No.5455 of 2019 Dt:27.3.2019 The Writ Petition is accordingly disposed of directing the Tahsildar, Nagaram Mandal, Suryapet District, to take appropriate action upon the petitioner's representation received on 13.11.2018 expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order, be it from whatever source. Pending Miscellaneous Petitions, if any, shall stand closed in the light of this final order. No order as to costs. ________________________ JUSTICE SANJAY KUMAR 27th March, 2019 dr
