THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.4803 of 2019 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Municipal Administration and Urban Development for the 1st respondent and Sri N. Praveen Kumar, learned Standing Counsel for the 2nd respondent. 2.

This writ petition is filed complaining inaction on the part of the 2nd respondent in mutating the petitioner's name in the municipal records in respect of house bearing H.No.9-3-54 (new) 9-3-51 (old) situated in Contractor Basthi, Bellampalli Town, Adilabad District, presently Macherial District and also in considering his representations dated 23.02.2015 and 15.10.2016. 3.

The 2nd respondent is bound to act only when an appropriate application is made along with the necessary documents and the prescribed fees for mutation. Therefore, the petitioner is required to place before the 2nd respondent all the necessary documents supporting his claim with respect to the subject property, particularly, the legal heir certificate and the declaration as to whether there are any other claims with respect to the subject property. However, since the representations made by the petitioner on 23.02.2015 and 15.10.2016 do not communicate any such application, liberty is given to the petitioner to make appropriate application in accordance with the procedure prescribed for mutation. As and when such

CKR, J W.P.NO.4803 OF 2019 application is made, the 2nd respondent shall take necessary action within a period of eight weeks thereafter.

With the above direction, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions, if any pending in this writ petition, shall also stand closed.
