THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.1271 OF 2016 ORDER:
1 This petition is filed under Section 482 Cr.P.C to quash the proceedings against the petitioners/A.2 and A.3 in C.C.No.417 of 2015 on the file of the Court of the Special Mobile Magistrate, Guntur.
2 At the time of arguments, the learned counsel for the petitioners has sought permission of the Court to permit the petitioners to withdraw this Criminal Petition, with liberty to avail the remedies available to them under law. He further requested that the presence of the petitioners/A.2 and A.3 before the trial Court may be dispensed with on each and every date of adjournment.
3 There is no dispute with the regard to the identity of the petitioners, who are accused Nos.2 and 3 in the case. Even if their presence is dispensed with, no prejudice will be caused to the 2nd respondent.
4 In the result, the Criminal petition is dismissed, granting the liberty as prayed for. The presence of the petitioners, who are accused Nos.2 and 3 in C.C.No.417 of 2015 on the file of the Court of the Special Mobile Magistrate, Guntur is dispensed with on each and every dated of adjournment. However, they shall appear before the trial Court as and when their presence is so required. As a sequel, the miscellaneous petitions, pending if any in this Criminal Petition, shall stand closed.
