HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 6390 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in not paying the gratuity and earned leave amount to the petitioner, as illegal and arbitrary. When the matter is taken up for hearing, it is submitted by the learned counsel for the petitioner that the petitioner has retired from service on 31.07.2000 on attaining the age of superannuation, but the grievance of the petitioner is that he was not paid the gratuity and earned leave amount.

This Court having considered the said submission is of the view that the writ petition can be disposed of directing the petitioner to submit a representation to the respondents.

Accordingly, the writ petition is disposed of directing the petitioner to submit a representation to the respondents seeking payment of gratuity and earned leave amount, within two weeks from the date of receipt of a copy of this order, and upon receiving such representation, the respondent shall consider the same and pass appropriate orders in four weeks thereafter, in accordance with law.
