THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 3898 of 2018 O R D E R:

Petitioner challenges the notification issued in 2016 proposing to appoint permanent dealer in respect of fair price shop in Eswaramma Indullu, Madanapalle Rural, Chittoor District, on the ground that the same is issued in violation of the guidelines mentioned in G.O.Ms.No.35, dated 17.09.2007, which mandate that two shops shall not be existed within one kilometer radius.

Considering the fact that the petitioner has come to the Court challenging the notification, dated 21.06.2016, in 2018, interests of justice would be served if a direction is issued to the respondents to ensure that the guidelines mentioned in G.O.Ms.No.35, dated 17.09.2007, are adhered to particularly in relation to maintaining distance between the two fair price shops. The writ petition is accordingly disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of.
