Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 4.
This Writ Petition is filed seeking to declare the action of the 3rd respondent in suspending the authorization of the petitioner vide order dated 31.12.2014, as arbitrary and illegal.
The petitioner is the dealer of fair price shop No.78, Narigapalle Village, Chittoor Mandal, Chittoor District, on permanent basis. While so, the Civil Supplies Deputy Tahsildar, Chittoor, inspected the fair price of the petitioner on 24.12.2014, noticed certain irregularities and submitted report to the 3rd respondent, based on which, the impugned order dated 31.12.2014 was passed suspending the authorization of the petitioner. Challenging the same, the petitioner preferred an appeal to the Joint Collector, Chittoor, who in turn, declined to interfere with the order of suspension and directed the 3rd respondent to complete the enquiry within a period of two months.
Since the impugned suspension order was passed
on 13.2.2015 and two months period has not been completed, the Writ Petition is premature and hence, the same is dismissed. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
