THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.3886 OF 2016 ORDER:

Heard.

The petitioners are aggrieved by the inaction of the 2nd respondent in considering their revision along with stay petition filed on 21-12-2015. The said revision is directed against the order of the 3rd respondent, dated 30-11-2015, whereunder the appeal filed by the petitioners was dismissed. It is stated that pending appeal, there was a stay and since the appeal was dismissed on 30-11-2015, the petitioners have filed a revision together with stay petition before the 2nd respondent. But, the 2nd respondent has not fixed any date of hearing in the revision petition nor considered the stay petition.

Since the petitioners filed revision along with stay petition on 21-12-2015, it is appropriate to direct the 2nd respondent to fix an early date of hearing in the said revision petition after notice to the petitioners and consider and pass appropriate orders atleast to the extent of stay petition filed by the petitioners. Since there was stay pending appeal before the 3rd respondent, status-quo existing as on today with regard to the lands in question shall be maintained, till the 2nd respondent considers and passes appropriate orders as directed above.

Accordingly, the writ petition is disposed of. Miscellaneous Petitions, if any, pending shall stand closed. _______________________ VILAS V.AFZULPURKAR, J 09.02.2016 Issue C.C. in three days (B/o) Prv
