HON'BLE Dr. JUSTICE CHILLAKUR SUMALATHA CRIMINAL PETITION No.2127 of 2023 ORDER:

Heard Sri A.Jagan, learned counsel for the petitioner as well as the learned Additional Public Prosecutor who is representing the Respondent-State.

This Criminal Petition is filed seeking the Court to modify the condition imposed with regard to production of solvency by the Court of Principal Sessions Judge, Jangaon, through orders dated 10.02.2023 in Crl.M.P.No.39 of 2023.

Learned counsel for the petitioner states that the petitioner, who is Accused No.4 in S.C.No.14 of 2022, which stood pending before the Court of Principal Sessions Judge, Jangaon, moved an application for grant of bail and the Court granted bail, however, directed the petitioner to furnish solvency worth Rs.50,000/- with two sureties. One among them should be a permanent Government employee having fixed abode. Learned counsel states that a further condition was laid that the surety shall produce necessary salary certificate intimating the concerned Department that he is standing as surety for the petitioner. Learned counsel
states that such a condition is very harsh and indeed, the petitioner, who could not get such solvency, is still in jail and therefore, the condition may be relaxed.

Learned Additional Public Prosecutor did not raise any serious objection for relaxing the condition imposed. 5.
Having considered the inability of the petitioner to produce such solvency, the condition regarding production of solvency is modified as under:- "The petitioner shall be enlarged on bail on his executing a personal bond for Rs.75,000/- (Rupees Seventy Five Thousand only) with two sureties for like sum each to the satisfaction of the concerned Court."

With the above observation, the Criminal Petition is allowed.

Miscellaneous petitions, if any pending, shall stand closed.
