HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.3984 of 2018 Order:

The petitioner states that he is the original owner of the land of an extent of Ac.1-72 cents situated in RS No.284/1C of Kudapa village, Reddigudem Mandal, Krishna District. His name was recorded in the pattadar passbooks and title deeds. While so, the third respondent preferred an appeal before the Revenue Divisional Officer-cum-SubDivisional Magistrate and he allowed the appeal of the third respondent on 08.11.2017. Against the said order of the Revenue Divisional Officer, the petitioner preferred revision before the second respondent under Section 9 of the ROR Act, 1971 and also filed stay petition on 06.01.2018. When no orders are passed on the stay application, the present Writ Petition is filed.

Since the revision was filed along with the stay application on 06.01.2018, the second respondent is directed to consider the stay application first and pass appropriate orders within a period of two (2) weeks from the date of receipt of a copy of this order. After disposal of the stay application, the main revision itself can be taken up for consideration and appropriate orders can be passed in accordance with law. The revision pending before the second respondent shall be disposed of as expeditiously as possible, but not later than three (3) months from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. Consequently, miscellaneous petitions, if any pending, in this writ petition, shall stand closed. There shall be no order as to costs.
