FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) WEDNESDAY, THE TWENTY EIGHTH DAY OF JANUARY TWO THOUSAND AND FIFTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.652 of 2015 BETWEEN Kanukanti Uday Kumar ... PETITIONER AND The State of Telangana, Rep. by its Principal Secretary (Department of Home), Secretariat Buildings, Hyderabad and others. ...RESPONDENTS The Court made the following:

ORDER:

Heard.

2. This writ petition is filed alleging that respondent No.3 is calling the petitioner to the police station in connection with Crime No.96 of 2014 pending on the file of respondent No.3, though petitioner is no way concerned with the said crime.

3. Instructions of the learned Government Pleader, however, show that petitioner was found involved in Crime No.65 of 2014 relating to which the investigation is already completed. It is also stated that petitioner voluntarily came to the police station, gave his finger prints and photos and thereafter,

appropriate charge sheet is already filed before the Judicial Magistrate of First Class, Adilabad District and the case is under trial. So far as crime No.96 of 2014, referred to by the petitioner, is concerned, it is stated that the said crime was registered under Section 379 IPC r/w section 3(1) of PDPP Act and Sections 20 and 29 A.P.Forest Act. However, the said case is registered against unknown offenders and it is still under investigation. However, petitioner was never called by respondent No.3 police in connection with said crime No.96 of 2014 is alleged.

4. Evidently, the said crime No.96 of 2014 is under investigation and, as such, respondent No.3 states that said crime is registered against unknown person and petitioner was never called to the police station in connection with the said crime. In the circumstances, let the investigation in crime No.96 of 2014 proceed in accordance with law and respondent No.3 shall file appropriate report/charge sheet before the jurisdictional court after completing the investigation expeditiously.

Writ petition is, accordingly, disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
