This Transfer Criminal Petition, under Section 407 of the Code of Criminal Procedure, 1973, is filed by the petitioner, requesting to withdraw M.C.No.21 of 2017 from the file of Family Court - cum - VIII Additional District Judge, Prakasam at Ongole, and transfer the same to the Court of Senior Civil Judge, Kavali, SPSR Nellore District, for trial and disposal in accordance with law. 2 .

Heard the learned counsel for both sides and perused the record.

The learned counsel for the petitioner would submit that the petitioner is apprehending life threat in the hands of the respondent No.2 and her parents. He made several representations to the police, Nellore, to take action for the misbehaviour of respondent No.2 and her parents and ultimately prayed to allow the application. 4 .

The apprehension of the petitioner is not based on any material. The same is invented for the purpose of this Transfer Criminal Petition. It is for the respondent No.2/ wife to find out the Court, which has jurisdiction to entertain her maintenance application. There are no merits in the Transfer Criminal Petition. 5 .
