THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION No.17015 of 2009 ORDER:(per Hon'ble Sri Justice Ramesh Ranganathan) This Writ Petition is preferred against the order of the Joint Commissioner (CT), Hyderabad refusing the petitioner's request for grant of stay pending disposal of the appeal preferred before the Appellate Deputy Commissioner (CT), Secunderabad (second respondent) for the assessment year 2005-06. Subsequent to the filing of this Writ Petition, the petitioner withdrew the appeal pending before the second respondent, and had questioned the assessment order in W.P.No.16945 of 2009.

Sri S.Dwarakanath, Learned Counsel for the petitioner, states that, as the assessment order itself is the subject matter of challenge in W.P.No.16945 of 2009, the instant Writ Petition has become infructuous.

Recording the submission of the Learned Counsel, the Writ Petition is dismissed as infructuous. Miscellaneous Petition pending, if any, shall also stand dismissed. However, in the circumstances, without costs.
