ORAL ORDER:

Heard learned counsel for petitioner and learned Government Pleader for Home.

This writ petition is filed alleging that police are unnecessarily harassing the petitioner by calling him to the police station repeatedly, affecting his right to life and liberty and sought to declare the action of police as illegal.

Based on the written instructions dated 11.3.2019 furnished by Sub Inspector of Police, Banjara Hills police station, Hyderabad, learned Government Pleader would submit that person by name Sadeep Prathani lodged a complaint dated 19.1.2019 alleging that he took lease of property from person by name Sudha Mantri and Surjith Singh, who was looking after the property, handed over the premises to him on 12.10.2017 and on 25.10.2017 he has executed an agreement of lease for three years; that he has sub leased the property to Mr Jahangir Khan to run 'Coffee Shop' and handed over premises to him on 26.7.2018; that on 31.7.2018 he got information that Jahangir Singh is serving hookahs and to stop the said illegality, he along with his partner Mr Pruthviraj went to the Coffee Shop and there was a raid by task force and a case was filed against Mr.

Pruthviraj; that the owner of premises and Mr. Surjith Singh trespassed into the premises and shifted furniture worth Rs.30,00,000/- and though several requests were made, the furniture is not being returned. It is further stated that on receipt of the complaint, Station General Entry was made on the same day and on further verification of the issue, no action was taken and complainant was informed to seek redressal in competent Court of law.

Thus, learned Government Pleader asserts that no further action was taken and complaint itself was closed.

In view of the statement of the learned Government Pleader, based on instructions that complaint lodged against petitioner was already closed, no further orders are required and the writ petition is disposed of. No costs. Miscellaneous petitions, if any pending, are closed.
