HONOURABLE SMT JUSTICE T.RAJANI CRIMINAL PETITION No.1427 OF 2018 ORDER:

This Criminal Petition is filed seeking grant of bail to the petitioner/accused No.2 in connection with Sessions Case No.136 of 2017 on the file of the learned I Additional District and Sessions Judge, Rajamahendravarm, East Godavari District.

Heard the learned Counsel for the petitioner and the learned Public Prosecutor appearing for the respondent. Perused the record.

Learned counsel for the petitioner submits that this petitioner is only the driver of the vehicle in which ganja is being transported.

A perusal of the mediator's report shows that this petitioner was not only the driver of the vehicle but also was actively participating in transportation of ganja by taking care to see that ganja is concealed properly. The ganja involved in this case is commercial quantity, i.e., 540 kgs. Hence, Section-37 of the Narcotic Drugs and Psychotropic Substances Act, 1985, comes in the way of granting bail to the petitioner.

Accordingly, the Criminal Petition is dismissed.

As a sequel, the Miscellaneous Petitions, pending if any, stand closed.
