Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 and 2.

This Writ Petition is filed seeking to declare the action of the 2nd respondent in suspending the authorization of the petitioner vide order dated 24.01.2015, as arbitrary and illegal.

The petitioner is the dealer of fair price shop No. 593, Durga Nagar, Kapra Municipality.

The authorization of the petitioner was suspended by the 2nd respondent on the ground that he was collecting money from the card holders for issuing new FSC cards. Thereafter, the stock was seized and the same was entrusted to nearby fair price shop No.73 to avoid inconvenience to the card holders.

The authorization can only be suspended for committing any irregularities in relation to distribution of commodities or violation of any control order. The suspension order is based on some extraneous ground, which is not connected with the duties of the fair price shop dealer.

Therefore, the impugned suspension order dated 24.01.2015 is set aside and the Writ Petition is disposed of at the admission stage. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
