THE HON'BLE SRI JUSTICE PRAVEEN KUMAR WRIT PETITION No. 19808 of 2016 ORDER:

Heard learned counsel for the petitioners and Sri K.Ramakanth Reddy, learned counsel appearing for AICTE. With the consent of both parties the writ petition is taken up for disposal at the admission stage itself.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the inaction of the 1st respondent in clarifying the issues raised by the petitioners in connection with the grant of approval/extension of approvals to the technical institutions including the petitioner's institutions in respect of the parameters prescribed by the 1st respondent in the approval process hand book 2016-2017, duly considering the latest representation submitted by the petitioners on 17.06.2016, as arbitrary, illegal and violative of principles of natural justice; and consequently direct the 1st respondents to issue clarifications forthwith on the issues raised by the petitioners in the representation.

Though various grounds raised in the writ petition, learned counsel for the petitioners restricts his prayer seeking a direction to the respondents to consider the latest representation dated 17.06.2016 made by the petitioners' college to the AICTE. It is his grievance that in spite of making number of representations seeking clarification on certain issues which according to him are understood in a different way by JNTU, he seeks clarification. Learned Standing Counsel appearing for AICTE submits that

since the petitioners are already granted permission, question of considering the representation again would not arise. As seen from the above, the request of the petitioner is to get some clarifications from AICTE with regard to the manner in which the admissions are to be made in various courses monitored by AICTE; apart from other issues on which there is no clarity. Hence, the writ petition is disposed of directing the respondents to dispose of the representation dated 17.06.2016 made by the petitioner, in accordance with law, within three (03) months from the date of receipt of a copy of the order. No order as to costs.
