Gummadi Brahmaji v. The Chief Executive Officer
THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.3954 OF 2018 ORDER:
The writ petition is filed by the petitioner questioning the action of the respondents in not allowing the petitioner to sell his organic agricultural produce at the rate of normal vegetables. 2.
Heard both sides and perused the material on record. 3.
The complaint of the petitioner is that he is not being allowed to sell the vegetables, which he claims to be organic produce, in spite of the fact that he was allotted a stall at serial No.25 in Patamata Rythu Bazar, in terms of the notice dated 15.12.2017.
4.
If there is already allocation of the stall in favour of the petitioner to sell the vegetables, he cannot be prevented from selling the same, be it organic or non-organic produce. 5.
There being no control order or law governing the prices of the vegetables, it is the market forces, which determine the sales and purchase of the commodities like vegetables. In those circumstances, the respondents shall not interfere with the selling of vegetables by the petitioner as long as permission granted to him by the Estate Officer of the rythu bazaar concerned is in existence. 6.
Hence, the writ petition is disposed of directing the respondents not to prevent the petitioner from selling the vegetables as long as permission granted to him by the Estate
Officer of the Rythu Bazar concerned is in existence. No order as to costs. Miscellaneous petitions pending, if any, in this writ petition, shall stand closed.
