Learned counsel for respondents is present. None appeared for the appellant.

When this matter was listed on 12.10.2022, as there was no representation on behalf of the appellant either in the forenoon or in the afternoon, this Court directed to list the matter under the caption "for Dismissal" today i.e.,13.10.2022.

Inspite of it, today also, there is no representation for the appellant either in the forenoon or in the afternoon. Therefore, this Court is constrained to dismiss the appeal for default/ non-prosecution.

Accordingly, the Second Appeal is dismissed for nonprosecution. There shall be no order as to costs. As a sequel, Miscellaneous Petitions, if any pending, shall stand dismissed.
