THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL REVISION CASE No.236 of 2011 ORDER:

This Criminal Revision Case is filed by the appellants-accused Nos.1 to 3, under Sections 397 and 401 Cr.P.C., challenging the judgment dated 31.12.2010 passed in Criminal Appeal No.51 of 2010 on the file of the Court of VII Additional Sessions Judge (FTC), Nizamabad at Bodhan and the judgment dated 05.7.2010 passed in S.C. No.13 of 2010 on the file of the Court of Assistant Sessions Judge at Bodhan.

At the time of the arguments, learned counsel for the petitioners, learned Additional Public Prosecutor representing the State and learned counsel for the second respondent-implead petitioner, submitted that the learned VII Additional Sessions Judge (FTC), Nizamabad at Bodhan may be directed to dispose of Criminal Appeal No.51 of 2010 on merits.

In view of the submission made by both parties, without going into merits of the main case, the judgment dated 31.12.2010 passed in Criminal Appeal No.51 of 2010 is hereby set aside. The learned VII Additional Sessions Judge (FTC), Nizamabad at Bodhan is hereby directed to dispose of Criminal Appeal No.51 of 2010, on merits, afresh.

With the above direction, the criminal revision case is disposed of. Miscellaneous petitions, if any pending in this revision shall stand closed.
