THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.2187 of 2025 ORAL ORDER:
Seeking the Court to enlarge the petitioners, who are arrayed as accused Nos.1 and 2 in Crime No.436 of 2023 of Jadcherla Police Station, Mahabubnagar District, on bail, the present Criminal Petition is filed.

The brief facts of the case are that on 18.07.2023, Talasani Ravinder Reddy, Panchayat Secretary of Kodgal village, lodged a complaint stating that a decomposed male body was found in an agricultural well. The body was unidentified and clad in blue jeans. A case was registered under Section 174 CrPC. During investigation, Mohd. Ghouse produced two accused who confessed to murdering Mohd. Khaleel, the deceased husband of one of the accused, due to alleged harassment. Their confessions were recorded, and they were sent to judicial remand with altered charges under Sections 302 and 201 read with 34 IPC.

Heard Sri K. Venkatesh Gupta, learned counsel appearing on behalf of the petitioners as well as Sri Syed
Yasar Mamoon, learned Additional Public Prosecutor appearing on behalf of the respondent - State. 4.
Learned counsel for the petitioners submitted that the petitioners are innocent and falsely implicated in the alleged offence. Except for their alleged confession, there is no independent evidence linking them to the death of the deceased. He further submitted that the material part of the investigation is completed and witness statements were recorded, they undertake not to interfere with the process. He contended that the petitioners have been in jail since 28.12.2024, and their prolonged detention would cause hardship to themselves and their families, particularly two young children of petitioner No.1, aged 5 and 7 years. Therefore, he prayed the Court to grant bail to the petitioners by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that the allegations leveled against the petitioners are serious in nature. Therefore, at this stage, granting of bail to the petitioners does not arise. Hence, he prayed the Court to dismiss the criminal petition.

After considering the submissions made by both learned counsel and reviewing the material available on record, it appears that the crime was registered in the year 2023, and the petitioners have been in jail since December 28, 2024. Since the material aspects of the investigation is completed, there are no pending cases against the petitioners, and 20 witnesses have been examined, this Court deems it fit and proper to grant bail to the petitioners subject to the following conditions:
i.
The petitioners shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Jadcherla.
ii.
The petitioners shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks, for the purpose of
investigation, and thereafter, as and when required.
iii.
The petitioners shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
