HON'BLE SRI JUSTICE CHALLA KODANDA RAM CIVIL REVISION PETITION Nos.172 and 267 OF 2015 COMMON ORDER:- Initially the matter was heard and on account of a doubt arising, the matter was directed to be listed under the caption 'for being mentioned'. Today, when the matter is listed, learned counsel for the petitioner submits as against the orders dated 20.01.2011 passed by this Court in L.A.A.S.No.250 of 2010 and Cross-Objection SR No.10271 of 2010 & L.A.A.S.No.221 of 2010 and Cross-Objection SR No.10276 of 2010, reducing the compensation amount from Rs.25,000/- to Rs.12,500/-, petitioner had carried the matter to the Hon'ble Supreme Court by filing Civil Appeal Nos.10336-10377 of 2013 and the same were allowed by an order dated 11.03.2015. Thereby, the order dated 20.01.2011 passed by this Court came to be set aside.
In that view of the matter, the petitioner is now entitled to claim higher compensation and thereby the petitions which he earlier made and the amounts claimed in E.P.SR.No.1814 of 2014 in L.A.O.P.No.4 of 2007 and E.P.SR.No.1815 of 2014 in L.A.O.P.No.14 of 2007, on the file of Principal Senior Civil Judge, Kothagudem, are also required to be amended.
In that view of the matter, learned counsel for the petitioner seeks liberty to withdraw the C.R.P.Nos.172 of 2015 and 267 of 2015 on the file of this Court as well as E.P.SR.No.1815 of 2014 in L.A.O.P.No.14 of and E.P.SR.No.1815 of in L.A.O.P.No.14 of 2007 on the file of Principal Senior Civil Judge, Kothagudem. The petitioner also seeks liberty to file fresh E.Ps. Accordingly, liberty is granted.
Considering the prayer made by the petitioner, I see there is an element of reasoned request and accordingly, these Civil Revision Petitions are closed with a direction to treat the E.P.SR.No.1815 of in L.A.O.P.No.14 of and E.P.SR.No.1815 of 2014 in L.A.O.P.No.14 of 2007 on the file of Principal Senior Civil Judge, Kothagudem, as withdrawn. It is also made clear, liberty is given to the petitioner to file fresh E.Ps., in the light of the judgment of the Supreme Court in Civil Appeal Nos.10336-10377 of 2013.
There shall be no order as to costs. Miscellaneous petitions pending, if any, shall also stand closed.
