THE HONOURABLE DR.JUSTICE G. RADHA RANI CRIMINAL PETITION No.2182 of 2024 O R D E R:

This Criminal Petition is filed by the petitioners - A1 and A2 to relax the bail condition in Crl.M.P.No.3474 of 2023 in Crime No.218 of 2023 of PS CCS, DD, Hyderabad passed by the Metropolitan Sessions Judge, Hyderabad, dated 06.10.2023.

Heard the learned counsel for the petitioners - A1 and A2 and the learned counsel for the Additional Public Prosecutor for the respondent - State. 3.

Learned counsel for the petitioners submitted that as per the directions of the Court while granting bail, the petitioners were regularly appearing before the Court since 06.10.2023 on every Monday and Wednesday at 10:00 AM before the Station House Officer, CCS, DD, Hyderabad. But till date, the investigation is not yet completed. As such, they filed Crl.M.P.No.3807 of 2023 to relax the conditions, but the said petition was dismissed by the trial court on 03.11.2023 observing that the investigation was at initial stage and that there were no reasons to relax the condition imposed. 4.

He further submitted that the petitioners were wife and husband, they were permanent residents of Tadikalapudi, Eluru. The petitioner No.2 was

Dr.GRR, J crlp_2182_2024 suffering with heart ailments and it was very hard to travel 400 Kms. from his place of residence to the Police Station and prayed to relax the condition. 5.

Learned Additional Public Prosecutor submitted that the petitioners were complying the conditions of this Court and were appearing regularly and further stated that the investigation was not yet completed and it would take some more time for completing the investigation.

Considering the submissions of both the learned counsel, it is considered fit to relax the above condition.

In the result, the Criminal Petition is allowed relaxing the condition imposed against the petitioners in Crl.M.P.No.3474 of 2023 by the learned Metropolitan Sessions Judge, Hyderabad, to appear twice in a week before the Station House Officer, CCS, DD - Hyderabad. However, they are directed to appear before the Investigating Officer as and when required by him. As a sequel, miscellaneous applications pending in this petition, if any shall stand closed.
