This Criminal Petition, under Section 438 of the Code of Criminal Procedure, L973 (Cr.P.C.), is filed by the petitioner/ accused, for grant of anticipatory bail in Crime No.1 14 of 2O2l of P.S. Patancheru, Sangareddy District, registered for the offences punishable under Sections 409 and 42O of the Indian Penal Code.

Heard the learned counsel for the petitioner/ accused, the learned Additional Public Prosecutor representing the respondentState and perused the record. The allegation against the petitioner/accused is that on 25.02.2021 at 20.00 hours the complainant lodged a complaint I stating that the petitioner/ accused worked as Service Manager of their branch from January 2077 to 22.06.2020 and had been one of the two joint custodians responsible for cash maintenance of the ATM and during verification on 29.06.2020, they noticed cash shortage of Rs.11,90,000/-. Hence, the complaint. Learned counsel for the petitioner/ accused would submit that the petitioner is an innocent person and never committed any offence as allegr:d by the respondent-police.

It is further submitted that the petitioner is a law-abiding citizen and has nothing to do with the alleged offence.

this Court for her release. Hence, he prayed to grant entieipatory bail to the petitioner/ accused.

Learned Additional Public Prosecutor representing the respondent-State opposed to grant anticipatory bail to the petitioner/ accused.

Having regard to the facts and circumstances of the case and as there is possibility of shortfall of amounts due to non-reflection of withdrawals in the accounts of the respective customers who draw the amounts through ATMs because of improper functioning of the ATMs, this Court is inclined to grant anticipatory bail to the petitioner/accused on some conditions.

Accordingly, the Criminal Petition is allowed and the petitioner/accused is directed to surrender before the Station House Officer, P.S. Patancheru, Sangareddy District, within a period of 15 days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/ accused on bail, on her executing personal bond for a sum of Rs.15,000/- (Rupees fifteen thousand only) with two sureties for a like sum each to his satisfaction. On such release, the petitioner/accused shall also abide by the conditions stipulated in Section 438(2) Cr.P.C and co-operate with the investigating officer in investigating the case.

Miscellaneous applications, if any, pending shall stand closed.
