When the matter is taken up for hearing, written instructions dated...02.2018 furnished by the Inspector Police, Cheepurupalli having jurisdiction over Budarayavalasa PS, Vizianagaram District are placed on record by the learned Government Pleader for Home and the said instructions, to the extent of their relevance read as under: - "It is submitted that there is a civil dispute between the petitioner and the 5th respondent herein in respect of the land in question, which is said to be the subject matter of OS No.4/ 14 on the file of the Junior Civil Judge Court, Cheepurupalli. But the allegation of the petitioner that the 3rd respondent has been interfering with the same is not correct. It is submitted that on the complaint of the 5th respondent herein, a case in Cr.No.23/ 2013 dt.

09-07-2013, under Sections 463, 464,415, 420 466, 468 r/ w.34 IPC was registered on the file of Budarayavalasa Police Station against one Palledu Ramamurthy & 3 others including the petitioner herein (A-4) wherein after completion of investigation strictly in accordance with law and as per the provisions of Criminal Procedure Code, the 3rd respondent herein filed charge sheet on 22-12-2017 and the same is now pending trial vide CC No.9/ 2018 on the file of the JFCM Court, Cheepurupalli. It is submitted that while the things stood thus, the petitioner (A-4) in Cr.No.23/ 2013 has filed the present writ petition before this Hon'ble Court making all false and baseless allegations against the 3rd respondent herein, in view of filing of charge sheet in Cr.No.23/ 2013 against the petitioner herein (A-4) who is presently facing trial in CC No.

9/ 2018 along with others before the Hon'ble JFCM Court, Cheepurupalli. It is submitted that the 3rd respondent herein has never interfered in the civil dispute of the petitioner with the 5th respondent at any point of time, including during investigation in Cr.No.23/ 2013, wherein charge sheet has already been filed on 22-12-2017 and the same is now pending trial vide CC No.9/ 2018 on the file of the Hon'ble JFCM Court, Cheepurupalli. All the allegations of the petitioner in this regard against the 3rd/ 4th respondent are totally false, baseless, concocted only for the sake of filing this writ petition and the same are hereby specifically denied." On noticing the said instructions, it is requested by the learned counsel for the petitioner to place the said instructions on record and dispose of the writ petition.
