HON'BLE SRI JUSTICE R.SUBHASH REDDY AND HON'BLE SRI JUSTICE A.SHANKAR NARAYANA WRIT PETITION No.25857 of 2015 ORDER : (per Hon'ble Sri Justice R.Subhash Reddy) This writ petition is filed by the petitioner challenging the E-Auction sale notice dated 06.07.2015 fixing the date of auction of the property on 20.08.2015.
2. In this case, E-Auction sale notice as contemplated under Rule 8(6) of the Security Interest (Enforcement) Rules, 2002 was issued on 06.07.2015, whereas the notice under Rule 9(1) of the said Rules was published on 04.07.2015. Therefore, this Court, by order dated 19.08.2015 granted interim stay of auction.
3. When the matter is called for hearing, it is represented by the learned Standing Counsel for respondent-Bank that the respondent-Bank is contemplating to take steps to issue a fresh E-Auction Sale Notice as and when they propose to sell the secured assets and hence the cause in this writ petition has become infructuous.
4. In view of the said submission, this writ petition is dismissed as infructuous. However, the respondent-Bank is given liberty to take steps in accordance with law. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
