Pulapaka Ramulu v. The State Of Andhra Pradesh
HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD WRIT PETITION No.3972 of 2016 ORDER:
The inaction of respondent No.3 in registering Crime No.216 of 2015, without including the offence under Section 307 IPC, is questioned in the Writ Petition as being illegal and arbitrary.
Learned Counsel for the petitioner submits that the police registered FIR for the offences under Sections 324, 504 and 506 read with 34 IPC, but have not registered under Section 307 IPC despite receiving grievous head injury.
Learned Assistant Government Pleader for Home (TG) submits that investigation has been completed and charge sheet has been field on 10.03.2016 before the Judicial Magistrate of First Class, Siddilpet.
Since investigation has been completed, no further orders are required to be passed in the Writ Petition. The Writ Petition is, accordingly, closed. However, petitioner is at liberty to approach Trial Court if he has any grievance regarding the nature of investigation conducted by the Investigating Officer.
Miscellaneous Petitions pending, if any, shall also stand closed.
